Registering to Operate from Non-Domestic Premises

From 1st January 2016 the law changed to allow childminders the flexibility to work from suitable non-domestic premises (not their house) ‘for up to half their time’ without separate registration. This means that if a childminder wants to open, for example, a before and after school / holiday club on school premises they will be able to.

The law states that childminders and providers of childcare on domestic premises may operate from one or more non-domestic premises under their registration for up to 50% of their total operating time. Childminders and childcare on domestic premises providers must decide for themselves how they will divide their care between domestic and non-domestic premises.

Please consider the following points:

  • The Premises Must Be Safe And Secure As Detailed In The EYFS And Childcare Register.
  • Inform Your Childminder Insurance Company
  • Complete Your Own Risk Assessment
  • Ratios and floor space must Be Maintained As Detailed In The EYFS
  • The Childminder Must Be Able To Show How Much Of Their Week They Are Working On Each Of Their Premises To Evidence That They Are Not On The Non-Domestic Premises For More Than Half The Week
